Information and informed consent

INFORMATION NOTICE

Telemedicine uses medical equipment, IT equipment and electronic communication technologies that make it possible to provide reporting, analysis and telemonitoring services with the help of clinical facilities located elsewhere.

The undersigned has been informed of the following.

The Specialist who will carry out the consultation will not be physically in the same room as the patient. The doctor and the nursing and technical staff may assist with the examination at every stage necessary for its successful outcome.

Doctorium guarantees that each Specialist is duly registered with the professional Order to which they belong (Order of Physicians, Surgeons and Dentists, Order of Psychologists, Order of Biologists, etc.).

The clinical, biological, audio and video data collected, necessary for the objective to be achieved, may become part of the documents and material of the doctor carrying out the video consultation. Such data must be used exclusively for documentation or healthcare purposes by all the persons involved in the exchange of information necessary to perform the service requested, as well as for any other organisational and administrative aspect, but only within the limits required by the purpose of collection and processing.

The undersigned has been informed, and is therefore aware, that Telemedicine services are equivalent to any other healthcare service, and must therefore always respect all the rights and obligations inherent in any healthcare act, even though Telemedicine services do not entirely replace traditional care services, but supplement them in order to improve their effectiveness, efficiency, appropriateness and sustainability.

The undersigned has also been informed of the existence of alternative methods of carrying out the consultation and, in particular, of the possibility of contacting facilities of the Italian National Health Service, companies affiliated with the health service and/or private companies providing the service by traditional methods; the undersigned has nevertheless chosen the video consultation as the means of consulting a doctor and therefore declares forthwith that they are willing to receive the service by telemedicine, since their “technological profile”, meaning their knowledge of and ability to use IT tools, allows them to do so.

To this end, the undersigned declares:

The undersigned has the right of access to their medical information. They may examine all the medical information documented during a Telemedicine encounter and obtain a copy of such information, in accordance with Italian law.

The undersigned is aware that, where deemed necessary by the Specialist, cognitive and intervention tools may be used for the prevention, assessment and treatment of medical and/or psychological conditions.

The undersigned is also aware that the healthcare professional, where they consider it necessary, may recommend consulting other healthcare professionals bound by professional secrecy. The user may express their dissent orally; in that case, the professional assumes no responsibility for the choice and/or treatment concerned.

The undersigned is aware that if, during the consultation, the Specialist detects indicators of a medical emergency, the Specialist is required to invite the user to call the emergency number 112/118 or the emergency number of the country where they are immediately or to go to the nearest emergency department, and may suspend the consultation. The undersigned acknowledges this and undertakes, in such cases, to follow the Specialist’s instructions promptly.

Furthermore, the undersigned is aware that any drug prescriptions issued by the Specialist fall within the Specialist’s sole competence and responsibility, including as regards prescribing appropriateness, compliance with the Guidelines of the Ministry of Health on telemedicine and the restrictions applicable to medicines that cannot be prescribed remotely. Doctorium is in no way liable for the appropriateness, correctness or effects of the prescriptions issued.

The healthcare professional is strictly bound to comply with the Code of Ethics of the Order to which they belong and is guided by the principles laid down in Article 3 of Law no. 219/2017 on informed consent.

The undersigned has been informed that the healthcare professional may assess and, where appropriate, propose the termination of the relationship when they find that there is no benefit from the intervention and that no benefit can reasonably be expected from its continuation. If requested, they may provide the information needed to seek other, more suitable interventions.

INFORMED CONSENT

The undersigned declares that they have fully understood all the information provided in this information notice on the Telemedicine service and on the methods of processing and storing data. They consent to the consultation being carried out by telemedicine and with the guarantees set out in this information notice. They have the right to refuse or withdraw their consent to Telemedicine and/or to the video consultation at any time, without this affecting their right to future care.

The undersigned consents to the recording of all clinical, biological, audio and video data necessary for the objective to be achieved in the specialist’s material and/or documentation. In case of need or doubt on the part of the Specialist providing the consultation, the Specialist may request a second opinion, and in that case this consent extends to the persons identified by the Specialist.

The undersigned is specifically aware of and accepts the risks that may be incurred when requesting Telemedicine services, namely the risks associated with the lack of physical contact and of the doctor’s clinical observation, and with the impossibility of a complete consultation, of administering therapy and of immediate intervention in an emergency.

The undersigned authorises the doctor to use their health data, but only in anonymous form — aggregated or disaggregated — for the purposes of scientific study, economic control of services, processing of epidemiological data and scientific or conference publications, in any case in compliance with the legislation in force on the matter.

The undersigned also authorises the transmission of data, invoices and reports, if requested, to the insurance companies that will cover the costs of the services and that the undersigned will expressly indicate, or — where this agreement is aimed at the provision of services, in whole or in part, by the Italian National Health Service — to the latter.

In this regard, the undersigned expressly authorises Doctorium S.r.l. to provide such documentation, for the undersigned’s personal use and in accordance with the purposes that the undersigned may declare to third parties.

The personal data of the undersigned are processed exclusively in accordance with Regulation (EU) 2016/679 (GDPR) and for the purposes and in the manner described in the privacy notice already accepted upon registration on the platform.

Should the undersigned not wish to give consent to the use of their data in anonymous form for scientific purposes and/or for the processing of data for epidemiological purposes, they will send an e-mail to amministrazione@doctorium.it, a certified e-mail (PEC) to doctorium@pec.it, or a registered letter to Doctorium S.r.l., via Martiri di Gerace 1847 n. 8, 88100 Catanzaro.
